To give everyone an opportunity to be heard and to ensure the presentation of different points of view, the Commission requests that members of the audience who speak: 1) Fill out a Speaker Card and submit it to staff; 2) Always address the Chair; 3) State his or her name and address; 4) State views succinctly, and; 5) Limit presentations to three minutes.

1. HOUSING ELEMENT UPDATE – INITIAL ENVIRONMENTAL STUDY/NEGATIVE
DECLARATION (ENV 12-117)

DESCRIPTION: Review of the revised public review draft of the Housing Element Update Initial Environmental Study/Negative Declaration.
RECOMMENDATION: Take public comment, provide direction to staff, close the public comment period, and continue the hearing to the Planning Commission meeting on September 19, 2012.

2. HOUSING ELEMENT UPDATE – GENERAL PLAN AMENDMENT (GPA 12-117)

DESCRIPTION: Amendment of the General Plan to incorporate the Housing Element Update into the General Plan.
RECOMMENDATION: Review the Housing Element Update and General Plan Amendment, receive public input, and continue the hearing to the Planning Commission meeting on September 19, 2012.

3. ACCESSORY DWELLING UNIT REGULATIONS (ZOA 12-055)

DESCRIPTION: Review of a Zoning Ordinance Amendment to add new regulations which permit new Accessory Dwelling Units (ADUs, aka second units, granny units or in-law units) which meet criteria in the R-1, R-2 and R-3 Zoning Districts and legalize existing unpermitted ADUs which meet criteria in the R-1, R-2 and R-3 Zoning Districts. The Zoning Ordinance Amendment also deletes Zoning Ordinance Chapter 10.21 (Second Units).
RECOMMENDATION: Review the draft Accessory Dwelling Unit Regulations, receive public input, and continue the hearing to the Planning Commission meeting on September 19, 2012.

4. PUNTSAG & BAZARSAD CHANGES TO AN APPROVED PROJECT/ 147 EDWARDS AVE (VA 12-036)

DESCRIPTION: Design Review Permit for changes to an approved project for the after-the-fact relocation of air conditioning condenser units at 147 Edwards Avenue (APN 065-292-04).
RECOMMENDATION: Deny without prejudice.

5. FIGEL RESIDENCE/ 22 ATWOOD AVENUE (DR-VA-EA-TRP 12-124)

DESCRIPTION: Design Review Permit, Variance, and Encroachment Agreement to allow modifications within the Atwood Avenue right-of-way, including construction of façade modifications, a mechanical room, retaining walls, stairs, paths, and landscaping, as well as demolition of the existing parking deck, in addition to modifications within the North Street public right-of-way, including construction of a two-car garage, a retaining wall, stairs, and landscaping at 22 Atwood Avenue (APN 065-203-02). A Tree Removal Permit is also being requested to allow for the removal of seven trees.
RECOMMENDATION: Approve subject to conditions.

ADJOURNMENT -- Not later than 10:00 p.m. 

APPEALS: Any decision of the Planning Commission may be appealed by filing an appeal form and the required appeal fee with the Community Development Department within ten (10) calendar days of the date of the decision. If you challenge a decision of the Planning Commission in court you may be limited to raising only those issues you or someone else raised at the hearing or on appeal to the City Council.

SPECIAL NEEDS: In compliance with the Americans with Disabilities Act (29 CFR 35.102-35.104 ADA Title 11), if you need special assistance to participate in this meeting, please contact the Community Development Department at 289-4128 or 289-4165. Notification 48 hours prior to the meeting will enable the City to make reasonable arrangements to ensure accessibility to this meeting.

STAFF REPORTS are available for review on the Saturday prior to the Planning Commission meeting at the Sausalito Library at 420 Litho Street and at the City’s website, www.ci.sausalito.ca.us. Staff reports are also available at the Community Development Department at City Hall during normal business hours and at the Planning Commission meeting. Materials related to an item on this agenda which are submitted after the distribution of the agenda packet are available for public review at the Community Development Department during normal business hours, at the Planning Commission meeting, and at the City’s website (subject to staff’s ability to post the documents prior to the meeting).
